Definitions
In this Agreement the following expressions will have the following meanings unless inconsistent with the context:
“ADI” means an Approved Driving Instructor;
“PDI” means a Potential Driving Instructor;
“Charges” means the fees and charges payable to us in respect of the Services for Part 1, Part 2 and Part 3 Driving Instructor Training, 3rd Party Online resources, and any
DVSA Test and DVSA Licence fees;
“DVSA” means the Driver and Vehicle Standards Agency;
“Part 1”, “Part 2”and “Part 3” means the relevant parts of the process specified by the DVSA to be undertaken by persons wishing to qualify as an ADI, being Theory (Part 1); Driving Ability (Part 2); and Instructional Ability (Part 3) and “Part” or “Parts” shall be construed as meaning any one or more of these parts as appropriate;
“DVSA Test Fees” means the fees paid to the DVSA for Part 1, Part 2 and Part 3 exams;
You may have other rights granted to you by law in addition to those set out in this Agreement. This Agreement does not affect those other statutory rights granted by law.
Learner Drivers
Your Instructor is a Self Employed Franchisee (‘Your Instructor’) of My Four Wheels Limited (‘we’, ‘us’, ‘our’).
Next Mile Driver Training acts as an agent for your instructor in receiving your payments for driving tuition other than payments made directly by you to your instructor. Where Next Mile Driver Training makes any bookings with, or supplies any information or documentation to you, or processes any payments for your lessons, then we act as the agent for your instructor. The contract for driving tuition is solely between you and your instructor.
Instructor Qualifications
The Driving & Vehicle Standards Agency (DVSA) is the government body that examines, licences and controls the standards of all driving instructors in the UK. Your Next Mile Driver Training instructor is examined, licenced and regularly checked by the DVSA. Next Mile Driver Training Instructors strive to deliver the highest quality of service and training. If you have any questions or doubts about your training, please contact your Instructor or the Office without delay to discuss.
General Conduct
Your Next Mile Driver Training Instructor is bound by a professional code of conduct, which ensures that all our instructors will be polite, tidy and will not smoke in the vehicle, they will also refrain from using a mobile telephone during a lesson. They will behave in a professional and ethical manner at all times.
You are also requested not to smoke or use a mobile telephone during lessons and are required to behave in a manner that does not provoke or intimidate the instructor. Aggressive or violent behaviour, either physical or verbal, will not be tolerated and all future lessons will be cancelled and tuition with Next Mile Driver Training will cease with immediate effect. In this event any monies that have been prepaid by the pupil will not be refunded.
Lessons
Following the submission of your contact details by My Four Wheels to your instructor and after the instructor has contacted you in the first instance and provided his contact details, it is the responsibility of you and your instructor for agreeing all matters relating to timing, location and duration of individual lessons.
Your Instructor may Issue you with an appointment card. It is your responsibility to ensure it is presented to the Instructor on each lesson so that scheduled appointments can be detailed. It is important that you keep this card safe, In the event of a dispute we will request sight of this card so that we can retrieve information from it to assist in a complaint situation. If you have a break in tuition for any reason it is the responsibility of you, “the pupil” to make contact with your Instructor to reschedule any future appointments. If you are unable to contact your instructor, you should in the first instance notify the office of any difficulty.
You must notify your instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any loss, of a valid provisional driving licence.
Tuition is only available to persons who meet the following criteria:
- Aged 17 or over
- Holds a valid UK provisional driving licence; and is legally entitled to drive in the UK
- Satisfies the minimum eyesight requirement
Payments and Bookings
All bookings are made in advance, with payment taken at the time of booking. This is by invoice, and payment made via one of the following methods:
- Bank Transfer
For a booking to be confirmed, payment must be received at least 72 hours prior to the lesson start. An unreceived payment will result in the booking being forfeited.
The cost of prepaid tuition is based on the lesson price at the time of booking, and the rate will be honoured for a period of up to 6 months, however where prices are increased and subsequent lessons are scheduled, and, or, booked they will be charged at the new rate.
Next Mile Driver Training reserve the right to make price increases at any point during the financial year as a result of increases in business running costs.
Price changes will also be made in the following circumstances:
- Where you have moved postcode area and requested reallocation to another instructor because your current instructor does not cover your new postcode area, you will be required to cover any difference in the hourly rate between those instructors where your new instructor charges a higher hourly rate.
- Where you have requested to switch instructors within the same postcode area and your new instructor charges a higher hourly rate than your previous instructor, you will be required to pay the difference in the hourly rate than your previous instructor
- If you make a change from manual to a vehicle with automatic (transmission) tuition, you will be asked to pay the supplement higher value
Cancellations
Notice to cancel a booked lesson must be received at least 48 hours before the start of the lesson. Failure to do so will result in being charged at the full hourly lesson rate.
If your instructor cancels a lesson without giving this minimum period of notice your instructor shall be responsible for rearranging the lesson.
Cancellations by you must be made directly by you by contacting your instructor. If the call cannot be taken, a voicemail should be left so that the instructor can return your call at a convenient time. If you are unable to contact your instructor, you should contact our dedicated Support Team during normal office hours, who will notify the instructor. Please note, that calls, emails, and contact forms are not acted upon until the first available working day. You must ensure sufficient notification time is given to take this into account. Next Mile Driver Training takes no responsibility for notificatoins that are not received in this situation.
If you do not give the required 48 hour notice period for cancellation of you lesson, you will be charged for the lesson concerned at the standard rate. Please note, where discounted lessons have been arranged, the discounted rate will not be granted for reimbursement to the instructor, and your instructor reserves the right for no further lessons to take place until this debt is paid.
In the event that you wish to cancel and or move the date of your practical driving test, the DVSA stipulates that you give 3 clear days’ notice, this means that you may/will lose your DVSA test fee.

- Any Special Offer course that is rated less than Standard Rate
Vehicle, Condition, and Mechanical Breakdowns
Next Mile Driver Training is committed to providing candidates with a duel-controlled, clean and tidy, roadworthy car at all times.
Next Mile Driver Training cannot be held responsible for disruption to candidate training due to unforeseen mechanical breakdown, but will of course endeavour to find a replacement vehicle as soon as possible.
Part 2 PDI training is provided in your own vehicle, as this is the vehicle you will take your test in. It is therefore the responsibility of the Part 2 pupil to ensure their vehicle is roadworthy, inclusive Vehicle Exise Duty, MOT, and appropriate insurance is in place.
Use of training vehicle for the driving test
Next Mile Driver Training can provide the use of the vehicle for the purposes of the DVSA Driving Test at the normal hourly rate, subject to the following conditions:
- You have been taking regular lessons with us for a minimum of 3 months and for a minimum of 25 hours, and achieved the required standard.
- Although you will be covered by our insurance, the excess for any claim is £XXX.XX. By using our car, you agree unconditionally to pay this excess if invoked, and any damages caused by you.
- You have reached the required standard of driving to attempt the practical test. A mock test will be required. Our decision is final.
- You understand that on test, you will be driving unsupervised, and as such you cannot expect any help from the examiner. The only exception to this is for Route Directions.
Smoking Policy
Next Mile Driver Training, has a strict no smoking policy within vehicles and affiliated buildings, including, but not limited to, DVSA Test Centres.
